Koi Zone Pond Cleaning & Pond Maintenance

This disclaimer (the "Agreement") outlines the terms and conditions for maintenance and cleaning services provided by Koi Zone. By engaging our services, you acknowledge the inherent risks associated with managing a biological environment and agree to the following terms:

1. The "Living Ecosystem" Clause

A decorative pond is a complex, living ecosystem, not a sterile environment. Biological processes are inherently unpredictable. While Koi Zone uses best of care, we cannot control every environmental variable (such as sudden weather shifts, oxygen fluctuations, or pre-existing pathogens) that may affect the pond's health during or after service.

2. No Guarantee on Livestock

Koi Zone takes every precaution to ensure the safety of your aquatic life. However, Koi Zone is not liable for the loss or illness of fish, amphibians, or aquatic plants.

Livestock health can be compromised by factors outside our control, including age, underlying disease, or genetic sensitivities.

The client assumes all risks regarding the survival of livestock during and after the maintenance process.

3. Stress Management & Water Quality

Cleaning and maintenance procedures - even when performed with the utmost care - can be invasive.

Stress: Netting, moving fish, or changing water parameters can cause temporary stress to livestock.

Water Chemistry: We utilize high-quality bottles of dechlorinator for water changes; however, significant water volume replacement can alter pH, KH, or temperature. Sensitive species may react poorly to these necessary changes.

4. Equipment Limitations & Pre-existing Conditions

Koi Zone is not responsible for the failure of mechanical components, including but not limited to:

Pumps & Filters: Older equipment may fail to restart after being powered down for cleaning.

Liners: UV-damaged or aging liners may develop leaks or tears when moved or cleaned.

Structural: We are not liable for the collapse of loose rockwork or the failure of aging plumbing fixtures.

5. Post-Service Expectations

Water Clarity: Cleaning often disturbs fine sediment. Temporary murkiness is normal and typically settles within 24–48 hours.

Algae Regrowth:  A professional cleaning removes existing debris, but it does not "cure" algae. Future growth is dependent on sunlight, nutrient loads, and the client’s ongoing filtration habits.

Note to Client: By scheduling service with Koi Zone, you agree that you have read, understood, and accepted these terms. Our goal is always the health and beauty of your pond, but we must operate within the realities of biological and mechanical limitations.

Absolutely.  Adding a formal sign-off transforms the disclaimer into a professional service agreement, ensuring both Parties are on the same page before the nets hit the water.

6. Acknowledgment of Terms

By signing below, the client acknowledges that they have read and understood the risks outlined above, specifically regarding the unpredictability of living ecosystems and the limitations of liability concerning livestock and aging equipment.

I authorize Koi Zone to proceed with the scheduled maintenance under these terms.
